Terms & Conditions

By accessing or using the website buildsense.in, the PropOS platform, or any associated APIs, plugins, or WhatsApp AI agents (collectively, the "Service"), provided by NM BuildSense AI Pvt Ltd ("BuildSense AI", "we", "us", "our"), you agree to be bound by these Terms & Conditions ("Terms").

If you are entering into these Terms on behalf of a company, real estate developer, or legal entity, you represent that you have the authority to bind such entity to these Terms.

BuildSense AI provides an AI operating platform designed for the real estate and construction domain. Our core offerings include:

• Riddhi AI: Conversational buyer inquiry handling, site visit scheduling, and property availability desk via WhatsApp.
• Siddhi AI: Real-time sales pipeline intelligence and broker attribution tracking.
• Riya AI: RERA compliance calendar monitoring, certificate collation, and deadline alert automation.
• Aryan AI: Construction-Linked Payment (CLP) milestone reminder workflows and payment tracking.
• Kuber & Dev AI: Budget overrun monitoring, vendor rate card validation, and site procurement tracking.

BuildSense AI agents utilize generative artificial intelligence and proprietary domain models. While our agents are ground-checked against uploaded developer documents (BOQs, floor plans, RERA filings):

• AI outputs (such as draft purchase orders, automated RERA reminders, and price quotes) are provided for operational assistance and must be reviewed by qualified human personnel where legally or financially material.
• Final legal filings with RERA authorities, formal contract executions, and banking fund disbursements remain the sole responsibility of the developer.
• BuildSense AI is not liable for regulatory fines or contractual disputes resulting from unverified human reliance on automated draft outputs.

You retain full ownership of all project documents, floor plans, pricing sheets, customer databases, and commercial data ("Developer Content") uploaded to the Service.

BuildSense AI retains all right, title, and interest in and to the PropOS software architecture, agent prompts, proprietary model fine-tunes, UI designs, trademarks, and documentation.

You agree not to:

• Use the Service to transmit spam, fraudulent WhatsApp messages, or misleading real estate price disclosures.
• Reverse engineer, decompile, or attempt to extract source code or core model weights from the PropOS platform.
• Upload malicious code, viruses, or illegal document content.
• Violate WhatsApp Business Messaging Policies or state RERA advertising regulations.

Enterprise subscription fees, API usage billing, and SLA terms are defined in individual Master Services Agreements (MSAs) executed with each developer. We reserve the right to suspend Service access in the event of unpaid dues or material breach of these Terms.

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
